REGULATIONS OF THE ONLINE STORE mkowalczewska.com

§1 General Provisions

1.1. The online store available at mkowalczewska.com is run by Małgorzata Kowalczewska, running a business at the following address: ul. Homera 185, Poznań, Poland, VAt 9562121185 hereinafter referred to as the Seller.

1.2. The Regulations define the terms and conditions of using the Online Store and the terms and conditions of providing electronic services by the Seller and selling Products to Customers via the Store.

§2 Definitions

The terms used in the Regulations mean:

2.1. Customer – a person who made a purchase in the Store or uses the services offered by the Store.

2.2. Product – a movable item available in the Store that the Customer can purchase.

2.3. Sales Agreement – a Product sales agreement within the meaning of the Civil Code, concluded between the Seller and the Customer.

§3 Placing Orders

3.1. Orders in the Online Store can be placed 24 hours a day throughout the year.

3.2. In order to place an order, the Customer should select the Product, its quantity and then follow the instructions displayed on the website.

3.3. Placing an order constitutes the Customer’s offer to the Seller regarding the conclusion of a Sales Agreement for the Products that are the subject of the order.

§4 Order fulfillment and payment

4.1. After placing the Order, the Customer receives an e-mail confirming that the order has been accepted for processing.

4.2. The execution of the order begins after the payment is credited to the Seller’s bank account.

4.3. Available payment methods are bank transfer and electronic payments.

§5 Right to withdraw from the contract

5.1. The consumer has the right to withdraw from a distance contract without giving a reason within 14 days of receiving the Product.

5.2. In the event of withdrawal from the contract, the contract is considered void and the Consumer is obliged to return the Product to the Seller.

§6 Complaints

6.1. The Seller undertakes to deliver the Product without defects.

6.2. The Customer has the right to submit a complaint if any physical or legal defects of the Product are found.

6.3. Complaints will be considered by the Seller within 14 days from the date of their receipt.

§7 Personal data protection

7.1. The administrator of Customers’ personal data is the Seller.

7.2. Personal data is processed for purposes related to the execution of orders and, if the Customer consents, also for marketing purposes.

7.3. The customer has the right to access, rectify and delete his data

or restriction of processing, as well as the right to object to processing, as well as the right to transfer data.

7.4. Detailed information regarding the processing of personal data is included in the privacy policy available on the Store’s website.

§8 Intellectual property rights

8.1. All content posted on the Store’s website, including texts, graphics, logos, photos, is protected by copyright and belongs to the Seller or was used under appropriate contracts and cannot be used without the consent of the Seller.

8.2. The Customer is obliged to use all content contained on the Store’s website only for his or her own personal use.

§9 Changes to the Regulations

9.1. The Seller reserves the right to make changes to the Regulations for important reasons, such as changes in legal provisions, changes in payment and delivery methods – in a way that does not worsen the conditions of use of the Store by Customers.

9.2. Customers will be informed about any change to the Regulations at least 14 days in advance.

9.3. Orders placed before the date of entry into force of changes to the Regulations will be processed based on the existing rules.

§10 Final provisions

10.1. In matters not regulated by these Regulations, the relevant provisions of the Civil Code, provisions on the provision of electronic services and other provisions of Polish law shall apply.

10.2. Disputes arising from the implementation of contracts concluded on the basis of these Regulations will be resolved by the court having jurisdiction over the Seller’s registered office.

10.3. The Seller makes every effort to ensure that the services offered are at the highest level, but does not exclude the possibility of periodic unavailability of the website due to technical reasons, e.g. during maintenance works. The Seller undertakes to remove any failures or irregularities as soon as possible.

These Regulations enter into force on the day of publication on the Store’s website.
